mainville.org acceptable use policy

This acceptable use policy is intended to ensure that mainville.org services remain useful for all.

mainville.org accounts are for individual, non-commercial use only.

Products and Services. Reference to any product or service herein must not be construed as an offer of such product or service.

Allowable Use. mainville.org services may only be used for lawful purposes. Transmission of any material in violation of any federal or state statute or regulation is prohibited. This includes, but is not limited to, copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. You agree to indemnify and hold harmless mainville.org from any claims resulting from your use of mainville.org services.

Any and all shell access accounts provided by mainville.org may only be used interactively. They may not be used to run unattended processes including, but not limited to, any IRC bot, cron job, or screen.

Email that is left on the email server will be automatically deleted after 90 (ninety) days of nonaccess. Email that has been read must be removed from the email server. All email accounts are subject to the same restrictions and policies of access accounts.

Commercial advertisements are not allowed in email sent from mainville.org email addresses, and will result in account suspension or cancellation.

Commercial advertisements are unwelcome in most usenet discussion groups and on most email mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter to determine whether advertising is allowed or not. Cross posting, or sending a message to many different off-topic newsgroups, is particularly unacceptable and will be treated as such. Sending a message, especially an advertisement, is by itself spamming unless the individual has specifically requested information. The spamming of one recipient is considered UCE, or unsolicited commercial email. UBE, or unsolicited bulk email is when there is multiple recipients of UCE. UBE is especially erroneous and will be treated as such by mainville.org.

Email is a person-to-person medium, not a broadcast medium.

You agree to abide by mainville.org policies concerning use of mainville.org services. Unsolicited advertisements via email, or via discussion groups whose charter does not explicitly allow advertisements, is specifically not an allowable use. mainville.org reserves the right to suspend access to service for your account(s) upon an indication of disallowed use.

Responsibility for Account Use. You are responsible for all use of your account(s) and confidentiality of password(s). mainville.org will suspend or change access upon notification that your password has been stolen, lost or otherwise possibly compromised. mainville.org is not responsible for any of your personal files which may reside online on mainville.org-owned and controlled computers. You shall be responsible for independent backup of your data stored online.

Unauthorized Use of Account. mainville.org will strongly react to any use or attempted use of an account or computer without the owner's authorization. Such attempts include "social engineering" (tricking other people into releasing their passwords), password cracking, security hole scanning, denial-of-service attacks (ping-flooding, sending packets with an illegal packet size, udp flooding, half-open tcp connection flooding, etc.) and the like.

Harassment or abusive use of email and other services is serious. mainville.org will handle incidents of harassment on a case-by-case basis, consulting with all parties involved, and reserves the right to release customer information to the proper authorities should it discover unlawful activity.

Any unauthorized use of accounts or computers by a mainville.org member, whether or not the attacked account or computer belongs to mainville.org, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and legal action, according to the seriousness of the attack.

Limitations on Resource Usage. mainville.org reserves the right to impose limits on the total amount of disk space and other resources available for your use on mainville.org-operated computers.

For any web service which may be provided by mainville.org, members may not use the web space for purposes that can be deemed as an attempt to sell or market a product or service. This space has been provided for an individual's personal, non-commercial use only. Any attempt to use this space for business use is in direct conflict with the terms of this acceptable use policy.

Email Privacy. Electronic mail passes through multiple mail servers on the internet as it passes from source to destination. One can never be guaranteed privacy from every possible mail server; therefore, someone seeking total privacy should use some encryption scheme to render their messages unreadable by eavesdroppers. mainville.org places a high value on privacy, and will only examine users' email when absolutely required (for example, when troubleshooting email delivery problems or when presented with a search warrant for the information.)

Illegal Material. mainville.org bears certain legal liabilities for the use of its computer network and equipment. As such, mainville.org must require that its customers do not use the mainville.org network for illegal purposes. When presented with a search warrant, mainville.org is obligated to release any information named therein, and will cooperate with the authorities in any criminal investigation of inappropriate Internet usage.

Unacceptable Forums Content. mainville.org will not edit your posts in the forums under any circumstance. You own your words, and you are responsible for what you say.

mainville.org may, at its discretion, delete posts. Following is a non-exhaustive list of material that is inappropriate and subject to deletion at any time:

  • Obscene or vulgar language
  • Pornography and obscenity, or any sexually-oriented material
  • Abusive, harassing, or bigoted speech
  • Material which mainville.org believes to be copyrighted, proprietary, or to contain trade secrets
  • Private information regarding individuals, or material that seems aimed at embarrassing or harassing individuals or invading their privacy
  • Chain letters, pyramid schemes, or solicitations
  • Irrelevant or off-topic material
  • Repeated posts ("floods")
  • Posts likely to or apparently aimed at disrupting the forum
  • Links to any of the above
mainville.org's failure to delete material does not constitute any form of approval of that material, nor a modification of this policy. mainville.org reserves the right to delete any message in this forum for any reason whatsoever.

At its discretion, mainville.org may revoke the access privileges of any individual, either temporarily or permanently.

However, mainville.org recognizes that the legal status of the internet has not yet been resolved satisfactorily, either through legislation or court precedent. Therefore mainville.org must make certain decisions regarding the illegality of various specific actions. Among the actions mainville.org considers illegal and therefore not allowed on its network are: unauthorized distribution of copyrighted material; exploitation of minors; unauthorized use of computer resources. mainville.org believes that the first amendment rights of free speech, freedom of the press, and freedom of association apply to the internet to the same degree as they do to print media, and that any attempt to infringe upon those rights is void of legitimacy.

Web Service. mainville.org services may include web service. In all cases, the web pages reside on mainville.org computer equipment, giving mainville.org some ethical responsibility for the content of such pages. mainville.org will handle potentially inappropriate web pages on a case-by-case basis.

At its discretion, mainville.org may grant you a nonexclusive, nontransferable, limited license to store documents on a mainville.org world wide web server, and to use the server at burst bandwidth speeds up to mainville.org's full capacity.

Domain Name Service. You are responsible to the domain name registrar for any fees they may charge.

Term and Termination. This agreement shall become effective on the earlier of the date the service application is entered into mainville.org systems or the end of one business day after receipt of application.

mainville.org, at its sole discretion, may terminate this agreement immediately or suspend your access to the service upon any breach of this agreement by you.

For your protection, mainville.org requests that all cancellation notices be via the account being closed or otherwise in writing. You are responsible for notifying mainville.org of your wish to terminate your account.

If applicable, any charges will continue to accrue until your notification to mainville.org of account termination, or until your account is suspended due to late payment. After 60 (sixty) days of nonpayment, mainville.org will close your account; you will then be required to re-subscribe, according to policies in effect at that time, in order to continue service.

Licenses granted hereunder will terminate automatically if you fail to comply with the limitations described herein.

Effect of Agreement. This agreement, which shall include the current and future schedules hereto, represents the complete agreement concerning this license between the parties and supersedes all prior agreements and representations between them.

Modification of Terms and Charges. mainville.org reserves the right to modify provisions of this agreement by notifying you via written or online notice at least 30 (thirty) days before the effective date of the change. Your use of mainville.org's services after such notice shall constitute your acceptance of the modifications to this agreement.

Force Majeure. mainville.org's performance hereunder is subject to interruption and delay due to causes beyond its reasonable control such as acts of nature, acts of any government, war or other hostility, civil disorder, explosion, power failure, equipment failure, industrial or labor disputes, inability to obtain necessary supplies and the like.

Severability. If any provision of this agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and all other provisions are unaffected.

Governing Law. This agreement shall be governed by and construed under the laws of the state of California, except as governed by federal law.

Waiver. Failure of any party to enforce any provision of this agreement shall not constitute or be construed as a waiver of such provision or of the right to enforce such provision.
